These Terms of Use and End-User License Agreement ("Terms", "Agreement") govern your access to and use of the SocialXchange application ("the App"). The App is provided by Kayra Yılmaz and İsmet Ozan Karabınar ("we", "us", or "our"). Please read these Terms carefully before using the App.
1. Acceptance of the Terms
By creating an account, signing in, or otherwise using SocialXchange, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. If you use the App on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.
2. Eligibility
SocialXchange is intended solely for verified students of the International University of Sarajevo (IUS) who authenticate with a valid university-provided Microsoft account. You must be of the minimum age required by applicable law and by the university's eligibility requirements to use the App. The App is not directed to children.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on an Apple device that you own or control, solely for your personal, non-commercial use within the student community. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent such restrictions are prohibited by applicable law.
4. Accounts and Authentication
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Authentication is performed through your university Microsoft account. You agree to provide accurate information, not to impersonate any person or entity, and not to create accounts for anyone other than yourself. We may refuse, suspend, or terminate accounts at our discretion, including where required to protect the community.
5. Objectionable Content and Abusive Behavior
There is zero tolerance for objectionable content and abusive users. You agree not to post, send, upload, or share content, and not to engage in conduct, that:
- is illegal, or promotes or facilitates illegal activity;
- is harassing, threatening, bullying, hateful, or discriminatory;
- is sexually explicit, obscene, or exploits or endangers minors;
- is violent or promotes self-harm;
- is fraudulent, deceptive, or constitutes spam;
- impersonates another person or misrepresents your affiliation;
- infringes the intellectual property, privacy, or other rights of others;
- involves the sale of prohibited, stolen, dangerous, or regulated goods; or
- is otherwise objectionable or violates these Terms or applicable law.
6. Content Moderation, Reporting, and Blocking
All user-generated content (listings, posts, comments, messages, and images) is subject to automated and manual moderation. Content that violates these Terms may be filtered or removed without notice. Every listing, post, message, and profile includes tools to report objectionable content and to block abusive users. Blocking a user immediately removes their content from your view and notifies us for review.
7. Enforcement
We review reports of objectionable content and act within 24 hours by removing the offending content and ejecting the user who provided it. We may issue warnings, remove content, and suspend or permanently terminate accounts that violate these Terms. To report content or appeal an action, contact us in the App under Profile → Help & Support or by email at rebucate@gmail.com. We respond to content reports within 24 hours.
8. Your Content and Responsibilities
You retain ownership of the content you create. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the App. You are solely responsible for the content you create and for your interactions with other users, and you represent that you have the rights necessary to submit it. You agree to use the App lawfully and respectfully, in keeping with a student community.
9. Transactions Between Users
SocialXchange is a platform that lets students discover one another's listings, posts, and requests. We are not a party to any transaction, sale, exchange, or arrangement between users. The App does not process payments. Any purchase, sale, trade, meet-up, delivery, or other arrangement is solely between the participating users, at their own risk. We do not verify the quality, safety, legality, or accuracy of listings or content, and we make no guarantees about any user's conduct. You are responsible for exercising caution, meeting in safe public locations, and complying with applicable law. We are not responsible or liable for any loss, damage, dispute, or injury arising out of interactions or transactions between users.
10. Prohibited Uses
You agree not to misuse the App, including by attempting to gain unauthorized access, interfering with or disrupting the service or its infrastructure, scraping or harvesting data, transmitting malware, circumventing security or moderation measures, or using the App for any unlawful purpose.
11. Third-Party Services
The App relies on third-party services, including Supabase (backend infrastructure), Microsoft (authentication and content screening), and Apple (distribution and push notifications). Your use of the App may be subject to those providers' terms, and we are not responsible for their acts or omissions. See our Privacy Policy for details.
12. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate or reliable, to the maximum extent permitted by applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the developers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App, interactions or transactions between users, or content on the App, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the greatest extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless the developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the App, your content, your interactions or transactions with other users, or your violation of these Terms or applicable law.
15. Termination
You may stop using the App and delete your account at any time via Profile → Delete Account. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the community or comply with law. Provisions that by their nature should survive termination (including Sections 8–14 and 16) will survive.
16. Governing Law
These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-law principles, except where mandatory consumer-protection or data-protection laws of your country of residence apply. Nothing in these Terms limits any rights you may have under mandatory law.
17. Apple App Store Terms
This Agreement is between you and the developers only, not with Apple. Apple is not responsible for the App or its content. To the extent permitted by law, Apple has no obligation to provide any maintenance or support for the App. Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement and may enforce it against you. Your use of the App must also comply with the Apple Media Services Terms and Conditions.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide additional notice through the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
